1. Introduction and Acceptance of Terms

Welcome to OriginsBot. These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the OriginsBot software application, website (originsbot.com), and related services (collectively, the "Service") provided by Quay Elements Pty Ltd, ABN 20 694 751 927, located in Queensland, Australia ("we", "us", "our", "Quay Elements Pty Ltd").

By downloading, installing, accessing, or using the Service in any way, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Quay Elements Pty Ltd. Please read them carefully before using OriginsBot.

2. Definitions

For the purposes of these Terms:

"Service" means the OriginsBot software application, website, and all related services provided by Quay Elements Pty Ltd.
"Software" means the OriginsBot macOS application that provides automation functionality for the Age of Origins mobile game.
"User", "you", or "your" means the individual or entity accessing or using the Service.
"Subscription Plans" means the Free, Gathering, and Pro tiers of service offered by OriginsBot.
"Free Plan" means the no-cost tier that allows management of one (1) device with auto-gathering and collection features.
"Gathering Plan" means the paid subscription tier offering unlimited devices and full gathering automation.
"Pro Plan" means the premium paid subscription tier offering all features including advanced automation and live screen preview.
"Third-Party Software" means software not developed by Quay Elements Pty Ltd, including but not limited to BlueStacks Android Emulator and Age of Origins game.

3. Game Automation and Risks

3.1 Violation of Game Terms of Service

OriginsBot is an automation tool that interacts with the Age of Origins mobile game through the BlueStacks Android Emulator. The use of any third-party automation tool violates the Terms of Service of Age of Origins and may be considered cheating by the game publisher.

3.2 Account Ban Risk

You acknowledge and understand that using OriginsBot carries inherent risks, including but not limited to:

Temporary or permanent suspension of your game account
Loss of access to in-game purchases, progress, and virtual items
Removal from alliances or game communities
IP bans or device bans imposed by the game publisher
Loss of any real money spent on in-game purchases

3.3 No Detection Guarantee

While we have designed OriginsBot to minimize detection through human-like behavior patterns, we make no guarantee, representation, or warranty that the Software will not be detected by the game publisher's anti-cheat systems. Detection methods evolve constantly, and no automation tool can be completely undetectable.

3.4 Assumption of Risk

BY USING ORIGINSBOT, YOU EXPLICITLY ACKNOWLEDGE THAT YOU ARE USING THE SOFTWARE AT YOUR OWN RISK AND THAT YOU ACCEPT FULL RESPONSIBILITY FOR ANY AND ALL CONSEQUENCES THAT MAY RESULT FROM ITS USE.

3.5 No Liability for Account Actions

Quay Elements Pty Ltd is not responsible for any actions taken by the Age of Origins game publisher or any other third party against your account. You agree that Quay Elements Pty Ltd has no liability whatsoever for account suspensions, bans, loss of virtual items, loss of in-game purchases, or any other consequences resulting from your use of OriginsBot.

4. Eligibility and User Accounts

4.1 Age Requirement

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or use the Service. By using the Service, you represent and warrant that you meet this age requirement. We do not knowingly collect information from individuals under the age of 18, as further detailed in our Privacy Policy.

4.2 Account Registration

To use paid Subscription Plans, you must create an account through our payment processor, Dodo Payments. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security and confidentiality of your account credentials
Notify us immediately of any unauthorized access or security breach
Accept responsibility for all activities that occur under your account

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or engaged in fraudulent, abusive, or illegal activity.

5. License Grant and Restrictions

5.1 Limited License

Subject to your compliance with these Terms, Quay Elements Pty Ltd grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the OriginsBot Software on a single macOS device for your personal, non-commercial use.

5.2 Single User License

This is a single-user license. You may not:

Share your account credentials or license with any other person
Allow multiple users to access the Software under a single license
Use the Software concurrently on multiple devices under a single account
Resell, sublicense, rent, lease, or otherwise transfer your license to any third party

5.3 Prohibited Activities

You expressly agree NOT to:

Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
Modify, adapt, translate, or create derivative works based on the Software
Remove, alter, or obscure any copyright, trademark, or other proprietary notices
Use the Software for any illegal purpose or in violation of any laws
Use the Software in any manner that could damage, disable, overburden, or impair our systems
Attempt to gain unauthorized access to any portion of the Service or related systems
Use the Software to develop competing products or services
Distribute, sell, or commercially exploit the Software or any portion thereof

5.4 Reservation of Rights

Quay Elements Pty Ltd retains all rights, title, and interest in and to the Software and Service, including all intellectual property rights. Any rights not expressly granted to you in these Terms are reserved by Quay Elements Pty Ltd.

6. Subscription Plans and Features

6.1 Free Plan

The Free Plan includes:

Smart Emulator Control (Auto-launches & closes to save computer resources)
Live Vision Preview (See exactly what the bot sees)
Automated Troop Training
Priority Discord Support

6.4 Feature Changes

We reserve the right to modify, add, or remove features from any Subscription Plan at any time. We will make reasonable efforts to notify you of material changes, but we are under no obligation to maintain any particular feature indefinitely. Features marked as "Beta" are experimental and may not function as intended.

7. Payment and Billing

7.1 Payment Processor

All subscription payments are processed through **Dodo Payments**. Your purchase is processed by Dodo Payments, who handles secure checkout and payment processing on our behalf.

By subscribing to a paid plan, you agree to Dodo Payments' applicable buyer terms and privacy policy. Quay Elements Pty Ltd does not store or have access to your full payment information.

7.2 Subscription Fees

Subscription fees are charged in Australian Dollars (AUD) and are billed monthly on a recurring basis. The subscription fee will be charged to your payment method on the date you subscribe and on the same day of each subsequent month.

7.3 Automatic Renewal

Your subscription will automatically renew each month unless you cancel before the renewal date. By subscribing, you authorize Dodo Payments to automatically charge your payment method on each renewal date.

7.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will apply to new subscriptions immediately and to existing subscriptions upon the next renewal after we provide you with notice of the price change. If you do not agree to a price increase, you may cancel your subscription before the renewal date.

7.5 Taxes

All prices listed are inclusive of any applicable sales taxes, such as VAT or GST. Our payment processor may calculate and collect applicable taxes at checkout in accordance with local regulations.

7.6 Failed Payments

If a subscription payment fails, your access to paid features may be suspended or terminated. Our payment processor may notify you and attempt to re-charge your payment method. We are not responsible for any overdraft fees or other charges resulting from failed payments.

8. Cancellation and Refund Policy

8.1 Try Before You Buy

We strongly recommend trying the Free Plan first to ensure OriginsBot is compatible with your system and meets your needs before purchasing a paid subscription. The Free Plan allows you to test the Software with one device to verify compatibility with your macOS version, BlueStacks configuration, and hardware setup.

By subscribing to a paid plan, you acknowledge that you have had the opportunity to test the Free Plan and understand the features provided.

8.2 Refund Policy

Monthly Plans (Gathering and Pro Monthly)

Monthly subscription plans are non-refundable once payment has been processed. You may cancel your monthly subscription at any time to prevent future charges, but you will not receive a refund for the current billing period. Access to paid features will continue until the end of your current billing period.

Pro Annual Plan - 7-Day Money-Back Guarantee

If you purchase the Pro Annual plan, you may request a full refund within 7 days of your purchase date. To request a refund, contact us via Discord or email at [email protected] with your purchase details. After 7 days, the Pro Annual plan is non-refundable except where required by law (see sections 8.3 and 8.6).

8.3 EU/UK Consumer Right of Withdrawal Waiver

If you are a consumer based in the European Union (EU) or United Kingdom (UK), you typically have a legal right to a 14-day "right of withdrawal" for digital content purchases.

By purchasing a monthly subscription and downloading or accessing the paid features of the Software, you explicitly consent to the immediate performance of this contract and the supply of the digital content. You further acknowledge that by doing so, you lose your 14-day right of withdrawal.

Our payment checkout process is designed to obtain this explicit consent and acknowledgment from you before completing the purchase. Note that the Pro Annual plan's 7-day money-back guarantee may provide additional protection beyond the EU/UK withdrawal right.

8.4 Cancellation Process

You may cancel your subscription at any time through the OriginsBot application or via the Dodo Payments customer portal. To cancel:

In-app: Navigate to Settings → Subscription → Cancel Subscription
Via Dodo Payments: Manage your subscription through the Dodo customer portal (a link will be provided at checkout and via email)
Via Discord: Contact our support team with your account details

8.5 Effect of Cancellation

Monthly Plans: You may cancel your monthly subscription at any time. Upon cancellation, your subscription will remain active until the end of your current billing period. You will not be charged for subsequent billing periods. Access to paid features will be revoked at the end of the billing period. No pro-rata refunds will be issued for unused time.

Annual Plans: If you cancel your annual subscription, you will continue to have access to paid features until the end of your annual billing period. No pro-rata refunds will be issued for annual plans canceled after the 7-day money-back guarantee period, except where required by law.

8.6 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement. If the Software fails to meet a consumer guarantee under Australian Consumer Law due to a major failure (such as software that does not work at all or has a significant defect), you may be entitled to a refund or other remedy. Please contact us to discuss any such issues.

9. Software Updates and Modifications

9.1 Updates

We may release updates, patches, bug fixes, and new versions of the Software from time to time. These updates may be necessary to maintain compatibility with the Age of Origins game, BlueStacks, macOS, or to improve functionality and security. You agree to install updates promptly when they become available.

9.2 Automatic Updates

The Software may include automatic update functionality. By using the Software, you consent to automatic updates being downloaded and installed without further notice.

9.3 No Guarantee of Compatibility

We do not guarantee that the Software will remain compatible with Age of Origins, BlueStacks, or macOS indefinitely. Game updates, emulator changes, or operating system updates may break functionality. While we will make reasonable efforts to maintain compatibility, we are under no obligation to do so.

9.4 Modification of Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

10. Third-Party Dependencies

10.1 Required Third-Party Software

OriginsBot requires the following third-party software to function:

BlueStacks Android Emulator: Required to run the Age of Origins game on macOS
Age of Origins: The mobile game that OriginsBot automates
macOS: OriginsBot is designed exclusively for macOS (version 14.0 or later recommended)

10.2 No Affiliation

OriginsBot is not affiliated with, endorsed by, or sponsored by the developers or publishers of Age of Origins, BlueStacks, or Apple Inc. All trademarks and registered trademarks are the property of their respective owners.

10.3 Third-Party Terms

Your use of third-party software is governed by the respective terms and conditions of those services. You are responsible for complying with all third-party terms, including but not limited to the Age of Origins Terms of Service and BlueStacks Terms of Use.

10.4 No Responsibility for Third-Party Services

We are not responsible for any issues, damages, or losses resulting from third-party software, including but not limited to BlueStacks crashes, Age of Origins server downtime, or macOS incompatibilities. Our obligation is limited to the OriginsBot Software itself.

11. Intellectual Property Rights

11.1 Ownership

All intellectual property rights in and to the Service, including but not limited to the Software, website, logos, trademarks, service marks, graphics, text, and other content, are owned by or licensed to Quay Elements Pty Ltd. These Terms do not grant you any ownership rights in the Service.

11.2 Trademarks

"OriginsBot" and all related logos and designs are trademarks of Quay Elements Pty Ltd. You may not use our trademarks without our prior written permission.

11.3 Copyright

The Software and all associated content are protected by Australian and international copyright laws. Unauthorized copying, distribution, or modification of the Software may result in civil and criminal penalties.

11.4 Feedback

If you provide us with any feedback, suggestions, or ideas regarding the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into the Service without any obligation to you.

12. Support and Availability

12.1 Best Effort Support

Support is provided on a best-effort basis through our Discord community. We will respond to user inquiries when time and resources permit, but we make no guarantee regarding response times or resolution of issues.

12.2 No Server Infrastructure

OriginsBot is a local macOS application that does not rely on server infrastructure operated by Quay Elements Pty Ltd. The Software runs entirely on your local machine and communicates directly with BlueStacks via Android Debug Bridge (ADB). As such, there are no server uptime guarantees or service level agreements.

12.3 Discord Community

Our primary support channel is through our Discord server. Pro Plan subscribers receive priority attention in support channels, but all users are encouraged to seek help from the community.

12.4 No Guaranteed Availability

We do not guarantee that the Software will be available, error-free, or functional at all times. The Software may be unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any downtime or unavailability.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALLNINES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY
IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
IMPLIED WARRANTIES OF NON-INFRINGEMENT
WARRANTIES REGARDING ACCURACY, RELIABILITY, OR AVAILABILITY
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
WARRANTIES THAT DEFECTS WILL BE CORRECTED

We do not warrant that:

The Software will meet your requirements or expectations
The Software will be compatible with your specific hardware or software configuration
The Software will be undetectable by anti-cheat systems
Your game account will not be banned or suspended
The Software will achieve any particular farming results or efficiency
Any errors, bugs, or defects will be corrected

USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. YOU ASSUME ALL RISK FOR ANY DAMAGE THAT MAY RESULT FROM YOUR USE OF OR ACCESS TO THE SERVICE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALLNINES, ITS DIRECTORS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE TO YOU FOR ANY:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES
DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE
GAME ACCOUNT SUSPENSIONS, BANS, OR RESTRICTIONS
LOSS OF IN-GAME PURCHASES, PROGRESS, OR VIRTUAL ITEMS
LOSS OF TIME OR BUSINESS INTERRUPTION
COST OF SUBSTITUTE GOODS OR SERVICES
DAMAGES ARISING FROM THIRD-PARTY ACTIONS

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14.1 Maximum Liability

To the extent permitted by law, our total aggregate liability to you for any claims arising out of or related to these Terms or your use of the Service shall not exceed the total amount you have paid to Quay Elements Pty Ltd in subscription fees during the twelve (12) months preceding the event giving rise to liability, or AUD $100, whichever is less.

14.2 Essential Purpose

The limitations of liability in this section shall apply even if any limited remedy fails of its essential purpose.

14.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded, restricted, or modified under Australian Consumer Law. If Australian Consumer Law applies, our liability for a failure to comply with a consumer guarantee is limited to, at our option: (a) in the case of goods, repairing or replacing the goods or paying the cost of repair or replacement; or (b) in the case of services, supplying the services again or paying the cost of having the services supplied again.

15. Indemnification

You agree to indemnify, defend, and hold harmless Quay Elements Pty Ltd, its directors, officers, employees, contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any third-party rights, including the Age of Origins Terms of Service
Any actions taken against your game account by the game publisher
Any damage to your computer, data loss, or other harm resulting from your use of the Software
Any claim that your use of the Service caused damage to a third party

This indemnification obligation will survive termination of these Terms and your use of the Service.

16. Privacy and Data Collection

16.1 Privacy Policy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. You agree that you have read and understood the Privacy Policy.

16.2 Local Operation

The OriginsBot Software operates locally on your macOS device. We do not collect, store, or transmit any information about your game accounts, farming activities, BlueStacks configurations, or automation patterns.

16.3 Data Collection

As described in our Privacy Policy, the only personal information we collect is your email address, which is required for account creation and subscription management via our payment processor (Dodo Payments) and subscription manager (Adapty).

17. Termination

17.1 Termination by You

You may terminate these Terms at any time by canceling your subscription and uninstalling the Software from your device.

17.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to:

Breach of these Terms
Fraudulent or illegal activity
Abusive behavior toward other users or our support team
Violation of intellectual property rights
Sharing or reselling your license
Reverse engineering or attempting to circumvent license restrictions

17.3 Effect of Termination

Upon termination:

Your license to use the Software immediately ceases
You must uninstall and delete all copies of the Software
Your subscription will be canceled (no refund will be issued)
Sections of these Terms that by their nature should survive termination will survive

17.4 No Refund Upon Termination

If we terminate your account for breach of these Terms, you will not be entitled to any refund of subscription fees paid.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Queensland, Australia, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

18.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Queensland, Australia for the resolution of any disputes arising out of or relating to these Terms or the Service.

18.3 Informal Resolution

Before initiating formal legal proceedings, you agree to first contact us via Discord or email to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes amicably.

18.4 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

19. Changes to Terms

19.1 Right to Modify

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Changes may be made to reflect changes in the law, the Service, our business practices, or for any other reason.

19.2 Notice of Changes

When we make material changes to these Terms, we will:

Update the "Last Updated" date at the top of this page
Provide notice through the Software or via email to registered users
Post an announcement in our Discord community

19.3 Acceptance of Changes

Your continued use of the Service after changes to these Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and cancel your subscription.

19.4 Review Responsibility

It is your responsibility to review these Terms periodically for changes. We recommend checking this page whenever you use the Service.

20. General Provisions

20.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and Quay Elements Pty Ltd regarding the Service and supersede all prior agreements and understandings, whether written or oral.

20.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

20.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of Quay Elements Pty Ltd.

20.4 Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be null and void.

20.5 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or fuel crises.

20.6 Relationship

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Quay Elements Pty Ltd. You have no authority to bind Quay Elements Pty Ltd in any way.

20.7 Export Compliance

The Software may be subject to export control laws and regulations. You agree to comply with all applicable export and import laws and regulations in your use of the Service.

20.8 Electronic Communications

By using the Service, you consent to receiving electronic communications from us. These communications may include notices about your account and information concerning or related to the Service. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
